Target audience: Experienced image/footage buyers looking to update on the state of the industry

The morning’s panel of picture professionals, who bring views from legal, technology, advertising, publishing, image creation and stock licensing, will examine the evolving role of copyright legislation, licensing models, agency and distributor relations, technology, and the growing use of video.

The image and footage world continues to change – and fast: digital photography and crowd sourcing has created explosive growth in supply; instant search and digital delivery allow buyers to push deadlines to the last milisecond; stock agencies seems to be in self-destructive competition with each other, selling ever more images for just a few dollars. Find out what all this means for you.

Licensing stills and footage: what you need to know

Target audience: Image/footage buyers looking for an introduction or refresher on copyright and licensing

This session will cover key aspects of sourcing, licensing and using images and footage: copyright, clearances, fair use, orphan works, general versus niche agencies, royalty free versus managed rights, etc. The kinds of questions our panel will be ready to answer include:

  • Do images of fine art require additional permissions?
  • Do I need additional clearances to use a photograph of a celebrity on my brochure cover?
  • If I find an image online, who should I contact about licensing it?
  • Any tips for getting better search results on an image agency’s website?
  • Do any agencies or photographers still do research?
  • If I license an image for a book cover, do I need to secure rights for the e-book version at the same time as for the printed edition?
  • How do I license an image for a print-on-demand product without knowing what the final print-run will be?
  • Is it OK to use a licensed image or clip multiple times in a single project?
  • What are the different pricing structures for footage?
  • Is music priced differently than other collections?

  • What are the restrictions or cautions that the SA component of a CC-BY-SA licensed photo requires for its use in printed material?
    Can museums really regulate the use of a photographer's photos if they allow photography and there is no copyright restriction on the work of art?

How do I register for a session?

Register for the image expo, and on the final page of the registration process check the box by your name and submit. On that page you will also find a button to register a colleague.

Owing to limited space, the sessions are strictly limited to professional image buyers. Please do not try to register if you are a photographer or student.

How do I submit a question?

To have the greatest chance of having your question answered, please submit it online beforehand (the sooner the better, so our panel can do their homework!) When you register for the session (see above), you will see a box at the bottom of the last page where you can enter your question. You can add or change your question after registering by clicking on the link in your registration confirmation email or by going back into the registration system and clicking on the link ‘Register (or check your registration) for the session.’

Chris SandbergChris Sandberg is a partner in the law firm Lockridge Grindal Nauen PLLP, where he leads the firm’s Technology and Utilities practice area. His specialties include copyright and trademark infringement. Chris also teaches copyright courses at the University of Minnesota Law School, and is Co-President of ASPP’s Midwest Chapter.

Doug DawirsDoug Dawirs is best known for his work in digital asset management, including developing the award-winning application Extensis Portfolio. He is currently developing an interactive online portfolio review service for Eyeist. He is also technical advisor to PACA and creator of PacaSearch, a multi-agency stock image index. Doug is the recipient of two MacWorld Magazine World-Class Awards and an Editors’ Choice Award, as well as a MacUser Editors’ Choice Award (Eddy).

Kimber Leigh NussbaumKimber Leigh Nussbaum is a freelance art buyer and producer with VSA Partners. Previous clients include Liquid 9/Quriosity Productions, Kim Knight Productions, The Marketing Store, Two x Four, and Y&R/Cavalry. Before going freelance Kimber worked as an Art Buyer at Ogilvy Chicago with clients such as SC Johnson, Kimberly-Clark, Midori, and American Express (on its “Shop Small” program). She is also the founder of a networking group for art buyers in Chicago.

Kim TannerKim Tanner, Senior Visual Content Manager at Zondervan-HarperCollins, is a photo researcher and art buyer in the publishing industry. Zondervan–HarperCollins produces a wide range of products including bibles, books, curriculums, academic resources, and digital products.

Tim KleinTim Klein began his career as a photojournalist at Sun Publications, drawn by the challenge of using photography to capture the truth about people and the world we live in. As a commercial and editorial photographer he has traveled all over the world to photograph amazing people and organizations such as Burberry, Wrigley, Charter One Bank, The Atlantic, Surface, Out Magazine, W, and Men’s Journal. Tim is the Co-Founder of CoEdit Collection. He is also the director of photography for Chicago Ideas Week.

Mary Ellen JensenMary Ellen Jensen is the business development director for Media Bakery in the Midwest and has serviced clients in search of stock for over a decade. Mary Ellen’s vast industry experience and direct contact with creative teams and buyers has helped her support editorial and commercial clients in search, rights negotiations and flat rate licensing packages. Clients have included American Greetings, Doner, DDB, Leo Burnett, McGraw Hill, Ogilvy, Dex Media, Proctor & Gamble, Standard Process and Wyse Advertising.

Doug BrooksDoug Brooks has been a leader and innovator in the picture industry for over thirty years. Having produced food and still-life photography for assignment and stock licensing, Doug went on to be Director of Acquisitions and Visual Resources at one of the larger publishing houses in the United States. Doug is currently working to extend the geographical markets of the Image Research Team, which specializes in finding and licensing beautiful and large-scale imagery for educational museum exhibitions and book publication. Doug is a National Board member of the ASPP.

Kevin ThompsonKevin Thompson, a member at Davis McGrath LLC in Chicago, practices primarily in the area of domestic and international copyrights, trademarks, and internet law issues. He is the author of the legal blog Cyberlaw Central (check out in particular the webinars on issues relating to photographers’ copyright, trademark infringement, right of publicity, and fair use in social media). Kevin is currently Vice Chair of the Intellectual Property Law Association of Chicago.

Judy FeldmanJudy Feldman is a principal of Feldman & Associates, for 30 years one of America’s largest independent photo research and permissions organizations serving publishers, book and content developers worldwide. Judy has served as ASPP National Education Chair, President of ASPP Midwest and, for the past ten years, along with her husband Roger, has represented ASPP on the Board of the PLUS Coalition. This past fall the Feldmans were recipients of ASPP’s Picture Professional of the Year award.

Darryl JacobsonDarryl Jacobson, Sales Manager at Superstock, an industry leading provider of stock photos with over a thousand photographers, artists, archives, museums and special collections from around the world. Darryl’s areas of specialization include image licensing, reproduction rights and permissions.

Diane ParadisoDiane Paradiso, Director of Sales and Licensing at WPA Film Library, has over twenty years’ experience in stock footage licensing in all media. WPA Film Library was founded in 1987 and has grown into a leading source of high-quality vintage and contemporary imagery.

Danita DelimontDanita Delimont, CEO of Danita Delimont Stock Photography, has over thirty years’ experience in selling travel- and nature-oriented images to travel and publishing clients, and describes herself as “a walking, talking Atlas of the World.” Former national president of ASPP, Danita has been honored as a NANPA Fellow and Jane Kinne Picture Professional of the Year (2009).
